    Story

    Colin Curtis is the sole beneficiary of his mother's estate, which consisted of her home.

    Due to a series of personal tragedies at that time Colin did not obtain the letters of administration to record himself as the owner of his mother's house. The house remained empty, though Colin continued to pay the bills.

    In 2012, unknown to Colin, an application was made to the Land Registry to have a squatter, Keith Best, recorded as the owner of Mrs Curtis' home. The Land Registry rejected the application, as they believed it to be illegal; Mr Best sought a Judicial Review.

    The High Court heard this in May 2014 and ruled that Mr Best could have his application considered. This was upheld in January 2015 by the Court of Appeal. However the Court did say that other applications should also be considered - apparently an acknowledgement of Colin's claim. Colin became aware of the situation when contacted by the Daily Mail in May 2014.

    The Land Registry sent out two notices to the same address in June 2014. To Mr Best and to Colin's Mother as the registered owner. It is not known what happened to the latter. The notice gave 65 days to respond. Colin made a separate application as administrator of his mother's estate. The Land Registry referred the matter to the Tribunal.

    The Tribunal ruled in April 2016 that Colin did not have the legal status to make the application within the terms of the 2002 Land Registration Act. Colin was also ordered to pay Mr Best's costs - in excess of £37,000 - which when added to his own costs exceed £60,000. Colin has 28 days to appeal.

    Colin is 81 and in poor health. Although he owns his sheltered living flat, his sole income is his state pension and benefits (£285pw). He has used all his money fighting this injustice.

    Colin needs your help. Without your support Colin could be forced to sell his home to pay legal costs. How can it be fair to make an old man homeless and give his inheritance to a squatter?

      We hope that there will be a feature article published in the Mail tomorrow, that will give more detail about Colin's case. Sadly certain elements may not be included as witnesses are anxious about going "on the record", and evidence will not be available before next week.
